Kids say racist shit all the time. This is no longer the day and age that allows the kids to handle it themselves though. I bet this isn't the first time your niece has had an issue with this girl either. Guess what, it's the fucking wetbacks that are bullies now around here. I've had to deal with my share of yelling at the school because of one kid that's been fucking with Robbie since the 3rd grade. Big fat fucking kid that likes to throw his weight around. Last time I threatened discrimination and calling the cops if they didn't do something.

I told my brother not to let them charge her with anything to ruin her future. Its stupid petty shit. When i went to HS we were walking the halls with guns and fighting all the time not once did the cops get called not even when 4 teachers got beat up for trying to break up a fight
